Woman ordered to repay debt to heirs

Upholding the verdicts of the lower courts, the Federal Supreme Court recently ordered a woman to pay back a debt of Dh50,000 — she had borrowed from her cousin who later died — to the heirs of the deceased. The woman was also ordered to pay a fine of Dh1,000.
As per court records, A.A., lodged a complaint against D.H., demanding the payment of Dh50,000 the latter had borrowed from her cousin (A.A.’s husband). D.H. denied borrowing the money.
Having failed to settle the dispute, the police referred the complaint to the Public Prosecution, which charged D.H. with breach of trust, and prayed that she be penalised in consonance with Article 404/1 of the Federal Penal Code No. 3/1997.
The Sharjah Federal Court of First Instance slapped the accused with a fine of Dh1,000, and referred the civil litigation to the court concerned to order her to pay back the Dh50,000 loan. The judgment was confirmed by the Federal Court of Appeal.
D.H. moved the Federal Supreme Court, which turned down her petition, upheld the fine ruling, and referred the civil litigation to the court concerned to order her to repay the loan.
In its verdict, the apex court pointed out that the testimonies of the prosecution witnesses proved her guilt. Source
